Terms and Conditions for Captures by Kayleigh

Welcome to Captures by Kayleigh! These Terms and Conditions ("Terms") govern your use of the website www.capturesbykayleigh.com (the "Website") and the services provided by Captures by Kayleigh ("we," "us," or "our"). By accessing or using our Website and services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Website or services.

1. Services Offered

Captures by Kayleigh specializes in professional dog photography services. Our services include, but are not limited to, photography sessions, digital image delivery, print options, and related products. Specific details regarding session types, packages, pricing, and deliverables will be outlined in individual service agreements or booking confirmations.

2. Booking and Payments

2.1 Booking Confirmation

All photography sessions must be booked in advance. A session is considered confirmed only upon receipt of a signed agreement (if applicable) and any required deposit or full payment, as specified during the booking process.

2.2 Pricing

All prices for services and products are listed on our Website or provided directly to you during the booking process. Prices are subject to change without prior notice, but any changes will not affect bookings already confirmed.

2.3 Payments

Payments can be made via credit card in the booking package. A non-refundable deposit of 50% may be required at the time of booking to secure your session. The remaining balance is typically due 24 hours before the session.

3. Cancellations and Rescheduling

3.1 Client Cancellations

If you need to cancel a session, please notify us as soon as possible.

  • Cancellations made 1 week before the scheduled session may result in the deposit being transferable to a rescheduled session within 1 year.

  • Cancellations made less than 48 hours before the session may result in forfeiture of the deposit.

  • No-shows will result in forfeiture of any payments made.

3.2 Photographer Cancellations/Rescheduling

In the unlikely event that Captures by Kayleigh needs to cancel or reschedule a session due to unforeseen circumstances (e.g., illness, equipment failure, severe weather), we will notify you as soon as possible and work with you to reschedule at no additional cost or offer a full refund of any payments made.

4. Copyright and Usage Rights

4.1 Copyright Ownership

All photographs taken by Captures by Kayleigh remain the sole intellectual property and copyright of Captures by Kayleigh. You are purchasing a license to use the images, not the copyright itself.

4.2 Client Usage

Upon full payment, you will receive a personal use license for the digital images. This license permits you to:

  • Print the images for personal display.

  • Share the images on personal social media accounts (with credit to Captures by Kayleigh).

  • Use the images for personal, non-commercial purposes. You may not sell, license, or use the images for any commercial purpose without explicit written permission from Captures by Kayleigh.

4.3 Photographer Usage

Captures by Kayleigh reserves the right to use the photographs for promotional and marketing purposes, including but not limited to:

  • Display on our Website and social media channels.

  • In portfolios, advertisements, and marketing materials.

  • Submission to contests or publications. If you prefer that your dog's images not be used for promotional purposes, please inform us in writing prior to your session.

5. Client Responsibilities

5.1 Dog Safety and Control

You are responsible for the safety and control of your dog(s) throughout the entire photography session. Please ensure your dog is well-behaved, leash-trained (if necessary), and comfortable in new environments. We recommend bringing treats, toys, and water for your dog.

5.2 Punctuality

Please arrive on time for your scheduled session. Lateness may result in a shorter session duration.

5.3 Disclosure

You agree to disclose any behavioral issues, health concerns, or sensitivities your dog may have prior to the session to ensure a safe and comfortable environment for everyone.

6. Limitation of Liability

Captures by Kayleigh will take all reasonable care in the performance of our services. However, we shall not be liable for any loss, damage, or injury to you, your dog(s), or your property during the session, except in cases of gross negligence or willful misconduct on our part. Our liability for any claim arising from our services shall not exceed the total amount paid by you for the specific service in question.

7. Privacy Policy

Your privacy is important to us. Please refer to our separate Privacy Policy for detailed information on how we collect, use, and protect your personal data.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Virginia, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Clarke County, Virginia.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our Website. Your continued use of our Website and services after any such changes constitutes your acceptance of the new Terms.
